PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING PRISMÉ. BY ACCESSING OR USING THE PLATFORM, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE PLATFORM.

1. About Prismé

Prismé is a personality profiling platform operated by The Brothers Prim (Pty) Ltd, a private company registered in the Republic of South Africa (Registration Number 2020/775091/07), with its principal place of business in Johannesburg, Gauteng.

The Platform provides personality profiles derived from eye colour science, haplogroup genetics, ancestral mythology and related research. All content is provided for informational, educational and entertainment purposes only.

2. Acceptance of Terms

By creating an account, accessing the Platform, or subscribing to any plan, you confirm that:

  • •  You are at least 18 years of age, or at least 13 years of age with verifiable parental or guardian consent
  • •  You have the legal capacity to enter into a binding agreement
  • •  You have read, understood and agree to these Terms and our Privacy Policy
  • •  All information you provide is accurate, current and complete

3. Nature of the Content — Important Disclaimers

THE PERSONALITY PROFILES, HAPLOGROUP ANALYSES, ANCESTRAL INTERPRETATIONS, RELATIONSHIP ASSESSMENTS, FINANCIAL PSYCHOLOGY PROFILES, HEALTH INFORMATION, AND ALL OTHER CONTENT ON PRISMÉ ARE PROVIDED FOR INFORMATIONAL AND ENTERTAINMENT PURPOSES ONLY. THEY DO NOT CONSTITUTE MEDICAL, PSYCHOLOGICAL, FINANCIAL, LEGAL OR PROFESSIONAL ADVICE OF ANY KIND.

Specifically, you acknowledge and agree that:

  • •  Personality profiles are interpretive frameworks, not scientific diagnoses
  • •  Haplogroup and ancestral data are based on population genetics research and are generalisations, not individual genetic analyses
  • •  Relationship compatibility assessments are not guarantees of relationship outcomes
  • •  Financial psychology profiles are not financial advice and should not inform investment decisions
  • •  Health and diet information is general in nature and does not replace consultation with a qualified medical professional
  • •  Parenting style profiles are not child psychology assessments
  • •  Career guidance is aspirational and does not guarantee employment outcomes
  • •  Chronotype and energy profiles are approximations only

You should consult qualified professionals — including but not limited to medical doctors, psychologists, financial advisors and legal counsel — before making any significant life decisions.

4. Subscription Plans and Payment

4.1 Plans

Prismé offers the following subscription plans:

  • •  Basic Plan: R30.00 per month — access to core personality content
  • •  Premium Plan: R100.00 per month — access to all content including Shadow Self, Love Languages, Financial Psychology, Celebrity Archetypes and all premium dimensions

4.2 Billing

Subscriptions are billed monthly via PayFast, South Africa's leading payment gateway. By subscribing, you authorise recurring monthly charges to your payment method. Prices are in South African Rand (ZAR) and are inclusive of applicable VAT where required by law.

4.3 Cancellation

You may cancel your subscription at any time through your account dashboard or by contacting us at legal@prismeancestry.com. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial months.

4.4 Refund Policy

All subscription fees are non-refundable except where required by applicable South African consumer protection law, including the Consumer Protection Act 68 of 2008. If you believe you are entitled to a refund under applicable law, contact us at legal@prismeancestry.com within 5 business days of the charge.

4.5 Price Changes

We reserve the right to modify subscription prices with 30 days' written notice via email or platform notification. Continued use after the effective date constitutes acceptance of the new pricing.

5. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at legal@prismeancestry.com if you suspect unauthorised access to your account. We are not liable for any loss resulting from unauthorised use of your account.

You may not share your account with others, create multiple accounts, or use automated means to access the Platform.

6. Intellectual Property

All content on Prismé — including personality profiles, haplogroup analyses, ancestral mythology interpretations, text, graphics, design and methodology — is the exclusive property of The Brothers Prim (Pty) Ltd and is protected by South African and international copyright law.

Your subscription grants you a personal, non-transferable, non-exclusive licence to access and view content for your own personal use. You may not:

  • •  Copy, reproduce, distribute or publish any content without prior written consent
  • •  Use content for commercial purposes
  • •  Create derivative works based on Platform content
  • •  Scrape, mine or systematically extract data from the Platform
  • •  Reverse engineer or attempt to extract the underlying methodology

7. Prohibited Uses

You agree not to use the Platform to:

  • •  Violate any applicable law or regulation
  • •  Harass, defame, discriminate against or harm any person
  • •  Upload malicious code, viruses or harmful software
  • •  Attempt to gain unauthorised access to any system
  • •  Impersonate any person or entity
  • •  Use personality profiles to discriminate against others in employment, housing or any other context
  • •  Make employment, financial, medical or legal decisions based solely on Prismé content

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE BROTHERS PRIM (PTY) LTD AND ITS DIRECTORS, EMPLOYEES AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM OR ITS CONTENT.

Our total cumulative liability to you for any claim arising from these Terms or your use of the Platform shall not exceed the total subscription fees paid by you in the three months preceding the claim.

Nothing in these Terms excludes liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any liability that cannot be excluded under applicable South African law.

9. Disclaimer of Warranties

The Platform and all content are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy or non-infringement.

We do not warrant that the Platform will be uninterrupted, error-free or secure, or that any defects will be corrected. We make no representations regarding the accuracy, completeness or reliability of any personality profile or related content.

10. Data Protection and Privacy

Your use of the Platform is governed by our Privacy Policy, which forms part of these Terms. By using the Platform you consent to the collection and use of your data as described in the Privacy Policy.

We comply with the Protection of Personal Information Act 4 of 2013 (POPIA) and applicable data protection law. Your personal data will not be sold to third parties.

11. Third-Party Services

The Platform integrates with third-party services including Supabase (database and authentication) and PayFast (payment processing). These services are governed by their own terms and privacy policies. We are not responsible for the practices of these third-party providers.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of South Africa. Any dispute arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of South Africa.

Before commencing legal proceedings, you agree to attempt to resolve any dispute by contacting us at legal@prismeancestry.com. We will make reasonable efforts to resolve disputes amicably within 30 days.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or prominent platform notice at least 14 days before the changes take effect. Continued use of the Platform after the effective date constitutes acceptance of the updated Terms.

14. Termination

We may suspend or terminate your account immediately, without prior notice, if you breach these Terms. Upon termination, your right to access the Platform ceases immediately. Provisions that by their nature should survive termination — including intellectual property, limitation of liability and dispute resolution — shall survive.

15. Severability

If any provision of these Terms is found to be unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and The Brothers Prim (Pty) Ltd regarding your use of the Platform and supersede all prior agreements, representations and understandings.
